Rose Tuition Ltd – Terms & Conditions

1. Introduction & Legal Status


1.1. Rose Tuition Ltd (“Rose Tuition”, “we”, “us”) operates as an employment agency, introducing self-employed tutors (“Tutors”) to clients (“Clients”: students, parents, guardians, or schools).


1.2. We do
not employ tutors ourselves (i.e. we are not an employment business). This means that:


  • Tutors are engaged as independent contractors.

  • We facilitate the introduction and payment, but we do not control tutors’ working hours, availability, or the rates they charge (beyond our commission)


1.3. These T&Cs govern (a) the relationship between Rose Tuition and Clients, and (b) the relationship between Rose Tuition and Tutors.


Regulatory context: As an employment agency, you are regulated under the Employment Agencies Act 1973, and the Conduct of Employment Agencies and Employment Businesses Regulations 2003. Clients and Tutors should understand this status. 

1.4. We comply with the minimum standards required by the Employment Agency Standards (EAS) Inspectorate.

2. Definitions


Define key terms for clarity. Example definitions:


  • Client: A person or organisation paying for tuition (parent, student, or school).


  • Tutor: A self-employed individual introduced by Rose Tuition to provide teaching services.


  • Session: A scheduled tuition lesson (1:1 or group).


  • Group Session: A class with multiple students.


  • 1:1 Session: A private lesson between a Tutor and a Client (or student).


  • Referral: A person (Client or Tutor) introduced to Rose Tuition by an existing Client or Tutor under our Referral Programme.


  • Commission: The fee Rose Tuition charges on top of the Tutor’s rate (never more than 50%).


3. Client Terms


3.1 Booking & Introduction


3.1.1. Clients request a Tutor via our platform; we facilitate introductions.


3.1.2. Once matched, Clients and Tutors agree on session times. Tutors set their own availability and hourly (or per-session) rates; Rose Tuition adds its commission to the rate.


3.1.3. Payment is collected via TutorCruncher / Stripe. Rose Tuition handles the financial administration but does
not employ Tutors.


3.2 Payment Policy


3.2.1. Payments for each session are taken on completion of that session via Stripe / TutorCruncher.


3.2.2. Our commission is included in the total amount paid by the Client; the Tutor receives their rate (minus any agreed fees) via the split-payment mechanism.


3.2.3. Failed payments: If payment fails, we may suspend further bookings until the issue is resolved.


3.3 Cancellation Policy


3.3.1. Group sessions (classes): Because spaces are limited, group session bookings are non-cancellable by the Client once confirmed.


3.3.2.
1:1 sessions: Clients must provide at least 7 calendar days’ notice to cancel without charge.


3.3.3.
No-shows or late cancellations (less than 7 days) will be charged in full.


3.3.4. Exceptional circumstances (e.g. illness) may be considered at Rose Tuition’s discretion, but refunds are not guaranteed and are handled case-by-case.


3.4 Client Conduct & Safeguarding


3.4.1. Parents or guardians must ensure a suitable learning environment (especially for online lessons): quiet, safe, and free from distractions.


3.4.2. For 1:1 sessions, at least one responsible adult should be present during the lesson unless agreed otherwise. (This aligns with your Welcome Pack expectations.)


3.4.3. Clients must treat Tutors professionally and respectfully. We reserve the right to terminate access to the platform if behaviour is abusive or inappropriate.


4. Tutor Terms


4.1 Self-Employment & Status


4.1.1. Tutors engaged via Rose Tuition are self-employed contractors. There is no employment relationship with Rose Tuition or with your Clients beyond the contract for services. This is consistent with treating Rose Tuition as an employment agency.


4.1.2. Tutors must comply with their own tax, national insurance, and business obligations.


4.2 Duties & Professional Conduct


4.2.1. Tutors must maintain the professional standards set out in our Tutor Handbook (onboarding document), including safeguarding, preparation, punctuality, and communication.


4.2.2. Tutors must have and keep up-to-date relevant qualifications, DBS checks, and insurance, and provide these to Rose Tuition when requested.


4.2.3. Tutors may set their own hourly/session rates and availability. Rose Tuition takes a commission (never more than 50%).


4.2.4. Non-solicitation: Tutors must not solicit Clients directly to bypass Rose Tuition’s platform without prior written agreement.


4.3 Payment


4.3.1. Rose Tuition handles payments via split payments (Stripe / TutorCruncher), distributing the Tutor’s portion after each completed session.


4.3.2. Invoices or payment statements will be available via the TutorCruncher system.


4.3.3. For any payment disputes, Tutors must raise the issue within 7 calendar days via our support or dispute resolution process.


4.4 Termination of Relationship


4.4.1. Either party may terminate the relationship  with reasonable notice of 7 calendar days or immediately in the case of gross misconduct or safeguarding concerns.


4.4.2. Upon termination, Rose Tuition will settle any outstanding payments in accordance with our pay-out schedule.


5. Referral Programme


5.1. Rose Tuition runs a Refer & Reward Programme for both Clients and Tutors. The rewards and conditions are as follows:


Clients referring Clients


  • £25 account credit for each successful referral (valid after 4 paid sessions)


  • Refer 3 clients → £50 credit; refer 5 → £100 credit


Tutors referring Clients


  • £25 gift voucher per successful referral (after screening + 4 paid sessions)


  • 5+ referrals → one-off £100 gift voucher


Clients referring Tutors


  • £50 account credit when the referred Tutor completes 10 sessions


Tutors referring Tutors


  • £50 gift voucher when the referred Tutor completes 10 sessions


5.2. Rules & Conditions


  • No self-referrals allowed (e.g. you cannot refer yourself under a different email).


  • Referred Clients must complete 4 paid lessons for the reward to trigger.


  • Referred Tutors must pass screening and safeguarding checks.


  • Rewards (credits or gift vouchers) are applied only after invoices are cleared and payments settled.


  • Rose Tuition reserves the right to amend or terminate the referral scheme at any time, with notice.


5.3. Tracking


  • Referrals must be submitted via our official referral form (or via the TutorCruncher/google form) for credit to be valid.


  • Rose Tuition will tag referred users in the system to ensure accurate tracking.


6. Online Lesson Policy


6.1. Environment & Equipment


  • Clients and Tutors must provide a safe, quiet, and appropriate space for online lessons.


  • Tutors should use the Lessonspace integration for all online sessions.


  • Clients should ensure good internet connection, working camera and microphone, and a suitable device.


6.2. Behaviour & Safeguarding


  • Both parties must act professionally.


  • Tutors may refuse to continue a lesson if a parent/guardian’s behaviour is disruptive or unsafe.


  • Recording: All online lessons are recorded and shared with the student and administrators. Tutors may not record lessons without explicit, documented consent from clients (or parents). Any recording must comply with your separate privacy/media policy.


6.3. Session Disruption


  • If there are technical problems (e.g. loss of internet), Tutor or Client should notify the other as soon as possible.


  • If the lesson cannot proceed, Rose Tuition may help to reschedule, but is not legally obliged to refund paid lessons outside of our cancellation policy.


7. Liability, Indemnity & Limitations


7.1. Rose Tuition acts as an introducer only. We are not liable for the teaching quality, outcomes, or any loss arising from the performance of the Tutor.


7.2. Clients engage Tutors directly once introduced; Rose Tuition’s liability is limited to facilitating matches, payments, and administrative services.


7.3. Tutors indemnify Rose Tuition against any claims, damages or costs arising from their delivery of tuition (e.g., safeguarding breaches, negligence).


7.4. Nothing in these T&Cs will limit or exclude any liability that cannot legally be limited (e.g. death or personal injury caused by negligence).


8. Complaints & Dispute Resolution


8.1. Clients or Tutors who wish to raise a complaint should contact Rose Tuition via email at d.rose@rosetuition.com


8.2. Complaints will be acknowledged within 5 business days, and a full response given as soon as possible (typically within 10 days).


8.3. If the dispute relates to payment, cancellation, or referral rewards, the matter will be escalated according to our internal dispute-resolution process.


9. Amendments & Governing Law


9.1. Rose Tuition reserves the right to amend these T&Cs from time to time. We will provide at least 30 days’ notice of any material changes via email and on our website.


9.2. These T&Cs are governed by the laws of
England & Wales. Any dispute arising under or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the English courts.


10. Acknowledgement & Agreement (Work-seeker / Client Confirmation)


Before first use, both Tutors and Clients must confirm they have read, understood, and agreed to these T&Cs. This fulfils your regulatory duty under the Conduct Regulations.
